You will now have received by email the text of Ed Peel's findings on your grievance appeal. Now that this matter is resolved we need to proceed with the consideration of the proposal to restructure the Accounts Department. I am therefore calling a meeting of Finance Committee for this coming Tuesday, 30th March. The meeting will be held in the Gibbs Room, commencing at 11 a.m. The papers are as circulated for Agenda item 9 of the FC meeting held on 4th February (discussion of which was of course postponed pending the outcome of the grievance process). You have I think a set of these papers but if you would like them to be re-sent to you please let me know: they include, of course, a copy of your comments entitled "Finance Committee Consultation - 04 February 2004".
You requested and I agreed that you could attend the 4th February discussion of Finance Committee on the re-structuring issue. I am assuming, therefore, that you would wish to attend the 30th March meeting for this item on the same basis. I am happy to agree to this but I would point out that your comments should be confined to substantive points concerning the restructuring proposal itself: there are very serious business issues here and it is important that the discussion remains focussed on them. This is not a re-hearing of other matters covered in your grievance. I would first invite you to make your comments briefly, and then It may be that members of the Committee will wish to ask questions on points you have raised, whether orally at the meeting or in your consultation note.
The Finance Committee will wish to have a discussion of the overall proposal before asking you to appear so I would suggest that you aim to make yourself available from 11.30 onwards. As there is nowhere comfortable near the Gibbs Room for you to wait may I suggest that you stand by in your office and a member of the Committee will come and collect you when the Committee is ready. If you do not wish to appear at the Finance Committee in person then you should please let me know.

Many thanks for your invitation but I do not wish to attend the Finance Committee meeting because I believe the outcome has been predetermined. When the so-called restructuring goes ahead I would like to request the following: (a) Termination Notice (b) A cheque for my pay to date including payment for the accrued holidays to date of termination and an explanation of how the payment is made up. (c) P 45 (d) A cheque for the redundancy payment and an explanation of how it is made up, which I accept as a part payment against any compensation I may claim from Keble College.

I understood that you did not wish to have any further correspondence by email so I was a little surprised to receive this. If as I deduce this is an acceptance of the offer made in the without prejudice letter to you from Manches dated 15 April, giving a deadline of 4 p.m. on 22.4.04 for such acceptance, I should remind you that this is conditional on your entering a compromise agreement with the College. Moreover, while the laptop and two keys have been returned you have not to my knowledge explained the whereabouts of the current VAT file or the audit file for 2003, and we still await either the return of these files or an answer from you as to their whereabouts. I am forwarding this email to Manches who will take forward the preparation of a draft agreement as specified in their letter to you. I would advise you to obtain legal advice as also stated there. The payment will be made and the P45, P60 and P11D forms will be sent once this is underway and the agreement has been signed. You should be in direct contact henceforth about these matters with Daff Richardson at Manches, who also needs your answer to her question about the VAT and audit files.

I emailed Manches on or about 17 April not to communicate with me via email but your letter was dated 2 April. I do not wish to communicate with the College solicitors. I was in fact replying to your letter of 2 April, which does not refer to a compromise agreement. I have no intention of entering into a compromise agreement with the College. I request that you pay me my legal entitlement. I have not touched the files referred to since November 2003 and therefore cannot help you. I have not taken any files belonging to the College from the office. As regards the rate of my pay I am surprised that I am now accused of paying myself an unauthorised payment. The evidence of authorisation is on files in the Bursar's office. There are 3 documents:
1. Memorandum from Ken to you and I. This refers to an enhanced payment of 1.65% so that there is no injustice. I have given a copy of this to Roger. It does not say that the arrangement was temporary.
2. A note from you confirming agreement.
3. A note from me concurring with Ken. I also corrected his memo as the increase was actually 1.35%
There were 4 members of staff affected by the pension transfer - myself, Deborah Rogers, Rex Tester and Janet Betts. Rex was not accepted by the USS and therefore OSPS had to accept him. Janet had just then started and so Ken felt that she should not be given the enhancement. That left Deborah and I to receive 1.35% non pensionable uplift. The expectation was 5% OSPS deduction but instead we had to pay 6.35% USS. So it was reasonable to offer the disadvantaged members the increase. There is also a note on file from our then actuary referring to the disadvantage. This was all above board and nothing untoward has happened as implied by Manches. I look forward to your confirmation of the date when I should expect payment from the College.
