I Edwin Peel, of Keble College, will say as follows:-
1. I am a Solicitor, Fellow and a Tutor in Law of the Respondent
2. I was asked by the Warden of the Respondent to hear the appeal against the findings made by Tim Jenkinson in a Grievance brought by the Claimant.
3. I considered the written grounds of appeal submitted on 4th March, 2004 and arranged to meet with the Claimant. I also invited, and received, written submissions from the Warden (8th March) and Roger Boden (10th March) in response to the Claimant's grounds for appeal.
4. The first meeting with the Claimant was held on 10th March. Mark Butchers (the Chaplain of the Respondent) was present as a witness. The meeting lasted about one hour when it was adjourned because of other commitments.
5. The meeting was re-convened on 18th March, with Mark Butchers again present as a witness, and lasted, on that occasion, about 2 hours.
6. At both meetings with the Claimant I made certain of the grounds of appeal and anything else which the Claimant wanted to bring to my attention.
7. Since the principal grounds for appeal were that Tim Jenkinson's decision was biased and had failed to take into account some of the complaints made by the Claimant, it was necessary to conduct what was, at least in part, a re-hearing of the original Grievance.
8. I read all of the evidence put before Tim Jenkinson in the original Grievance.
9. I interviewed Roger Boden on 19th March.
10. I interviewed Tim Jenkinson on 23rd March.
11. I invited and received (on 25th March) a written submission from Janet Betts (Domestic Bursar of the Respondent).
12. I invited and received a further written submission from the Claimant (on 25th March) in response to the written submission made by Roger Boden on 10th March.
13. For the reasons which are set out in my report of 26th March, 2004, I found that the appeal made by the Claimant was not upheld.
