I SIR ROGER ELLIOTT of 11 Crick Road, Oxford, MAKE OATH and say as follows:-

I am Secretary to the Delegates and the Chief Executive of Oxford University Press and I am authorised to make this Affidavit on behalf of the Defendants. Except where otherwise stated, all facts and matters deposed to are within my own knowledge.

2. I make this Affidavit in order to clarify a matter which has come to my attention since swearing my first Affidavit on 19 July 1989.

3. There is now produced and shown to me marked "RE 2", a document [a set of undated computer printouts, later in court ruled inadmissible] listing the details of publishing proposals accepted at the Delegates' Meeting on 23 July 1985.

4. I have been informed by Jean Margaret Goodall and I verily believe that this document was compiled by her at some time during the week following the Delegates' Meeting on 23 July 1985. Jean Margaret Goodall was at the time, and remains, the Secretary of the Secretary to the Delegates of Oxford University Press.

5. I have been informed by Jean Margaret Goodall and I verily believe that she compiled only one copy of this document and that this document was for her use in the preparation of statistics.

This Affidavit sworn at Walton Street in the County of Oxford and filed on behalf of the Defendants, 31st January 1990.
