Do you know the Powers of the Police under The Police and Criminal Evidence Act 1984 ( PACE ) ? Have you been arrested or searched ? If you have been the subject of a search warrant do you know the contents of the Information given by the police on oath to the court in your absence to obtain the warrant ? Have you ever been the subject of a Production Order ? If so have you seen the document sworn to as true by the Police before the court to obtain the Order ? If the answer is no then how do you know whether the search warrant or Production Order was obtained lawfully and that the Information sworn to as true by the Police was in fact accurate and true and how do you know whether or not the Police made a mistake or simply misled the court to obtain what they wanted ? Did you get the impression that the Police had no evidence against you but were hoping to find some to justify the search/seizure/Production Order ? Have you ever reported the conduct of the Police and received a visit from an Inspector appointed to investigate your complaint who encouraged you to deal with it by way of informal resolution ? Have you ever been lied to by the Police ? Do you have a grievance at the way in which you have been treated by the Police ? Do you suspect that your treatment cannot have been correct but don't know if your feeling is right and/or if your treatment was illegal ? Has your office or home been searched and goods seized ? Has your computer been seized ? Have you invited Police Officers into your home and/or office thinking you were helping but then been arrested and searched ? Should you be thinking of civil proceedings e.g. an action for; (a) wrongful arrest (b) wrongful detention (c) wrongful search/seizure (d) Assault (e) malicious prosecution (f) misfeasance in a public office (g) negligence (h) damages Should be thinking of a report to the Police Complaints Authority against the Police at the same time as you may be being prosecuted and/or suing the police ? The Commissioner for the Metropolitan Police, Sir Paul Condon has said that we all have a duty to report bad policing. If you want to know where you stand call us. New Register We are keeping a register of the names and details of all Police Officers whose conduct has given cause for concern. This data base will be checked and used to investigate complaints and monitor the future conduct of the officers concerned and will be available to solicitors.
