OUR TERMS OF REFERENCEFor the benefit of new residents, the Association was formed many years ago with the principal
objective of raising and administering funds for the maintenance of the private road through Wilmslow Park.
Although the maintenance of Wilmslow Park North and South is primarily the responsibility of individual
frontagers, it is accepted by the majority of residents that it would be inequitable to expect the relatively few actual frontagers to bear the costs of remedial work when all residents on the Park have to use the road
to gain access to their homes. The Association was formed to give all residents the opportunity to make a voluntary contribution towards these costs since, in the absence of any other co-ordinating body, this is clearly
the most fair and reasonable way of ensuring repairs are carried out.
The Association will use the funds raised to: -
a) maintain the surface
of the road and footpath through Wilmslow Park in a reasonable condition commensurate with the nature and substructure of the road.
This includes repairs to kerbs and maintenance of speed humps and road markings. It
does not include major subsidence, however caused, and frontagers may wish to ensure that their household insurance covers such matters. It also excludes repairs to driveway crossover points on the footpath.
b) ensure
that the Public Utilities (or anyone else) who disturb the road or footpath re-instate it in accordance with their statutory obligations.
c) arrange sweeping of the road and footpath once a year after the leaves have
fallen. In practice, as the Council now sweeps the road, we are in their hands as to the exact date. We also arrange emptying of the gullies some time after the leaves have been cleared.
Other than the annual
gulley emptying, we are not responsible for maintenance of or repairs to drainage pipes. Frontagers are responsible for their drainage and sewage connections up to the point where the pipes connect to the main sewer and
are advised to ensure their household insurance covers this. Similarly, except for the annual sweep, cleanliness of the footpath rests with individual frontagers.
d) to maintain the Prohibition of Entry Order and the
private road status thus limiting use of the road to residents, visitors and bona fide trades people.
This includes provision of signs at each end of the road and closure of the road at appropriate times.
e) to use
all reasonable means to control traffic on the road at suitable speeds in order to ensure the safety of all users.
All these aims are, of course, subject to the availability of funds and priority goes to road and
footpath maintenance.
All committee members are volunteers and within the constraints of their time the Association does, in practice, do more than the above. Examples are:- replying to solicitors' enquiries, ensuring
developers protect the environment, endeavouring to ensure Tree Preservation Orders are observed, dealing with Macclesfield Borough Council on a variety of issues and so on. Whilst none of these activities can be
guaranteed, committee members will do their best to represent the interests of all residents. However, it is not intended, nor is it appropriate for the Association to supersede the responsibilities of individual
frontagers but rather to supplement them in the ways defined above
What can I do to help?
Everyone can help by sending their annual contributions promptly. We usually have to deliver 80 - 100 reminder letters in
January which is time consuming and costly.
Frontagers can help by:-
-Keeping the footpath clear of litter, including leaves in the Autumn.
-Keeping the drain grids clear to reduce flooding problems
-Trying to
ensure that visitors and tradespeople do not park on the footpath.
-Keeping hedging and trees trimmed back ensuring they do not encroach and overhang the footpath or obscure lighting.
