Will of John HOGGARTH (made 13 July 1840) c. 1875 - 1856

This is the last Will and Testament of me John Hoggarth of Newbegin in the Township of Egton in the County of York Farmer made this thirteenth day of July One thousand Eight hundred and forty I give and bequeath the following Legacies or sums of money namely To my daughter Ruth Fletcher the sum of Ten pounds. To my Grand daughter Jane Fletcher the like sum of Ten pounds. To my daughter Mary Laugton the like sum of Ten pounds. To my daughter Hannah Sellers the sum of Seven pounds. To my son George Hoggarth who is now in America the sum of Ten pounds, and to Jane Mead my wifes daughter the like sum of Ten pounds, which said several sums I request may be paid to the said several legatees at the expiration of twelve calendar months after my decease, and also the following legacies or sums of money namely To my daughter Ann Hoggarth, son Philip Hoggarth daughter Margaret Hoggarth and son John Hoggarth the sum of Fifty pounds Each, and which I request may be paid to them as and when they attain their several and respective ages of twenty one years - I give and bequeath all and Every my household goods and furniture plate linen and china and implements of household to my wife Esther Hoggarth absolutely I also give and bequeath my farming stock crops chattels monies and securities for money and all other my personal estate and effects not hereinbefore otherwise disposed of unto and to the use of my said wife and my friend Francis Yeoman of Grosmond Haggs in the Township of Egton aforesaid Yeoman and I declare that they shall stand possessed of the same upon the following trusts Upon trust in the first place to pay thereof all my just debts funeral and testamentary Expenses and afterwards the several legacies or sums of money hereinbefore bequeathed and as to the residue of my said trust monies personal Estate and Effects Upon trust to pay over and transfer the same to my said wife absolutely, nevertheless it is my particular wish and request that my said wife will by her last Will and Testament dispose of any property which she may die possessed of unto and equally all and every the said several legatees hereinbefore named in this my Will - And lastly I appoint my said wife and my friend Francis Yeoman Joint Executors in trust of this my last Will and Testament and I declare and direct that it shall and may be lawful for them to retain and reimburse themselves all reasonable expenses costs and charges which they may severally incur or be put to in carrying into execution the trusts of this my Will and I declare that they shall not be answerable for the acts neglects or defaults of each other but each of them for himself or herself only and by no means for involuntary lapses - In witness whereof I have hereunto set my hand the day and year first before written.

I do hereby certify that on the nineteenth day of July in the year of our Lord 1856, Esther Hoggarth of Newbegin of the Parish of Egton in the county of York Widow the Relict and Francis Yeoman, of Grosmont Haggs in the same township Farmer, executors named in the last Will an Testament of John Hoggarth, late of Newbegin aforesaid, in the Diocese of York, Farmer, deceased, were sworn well and truly to execute and perform the same, and that the whole of the goods chattels and credits of the said deceased, within the Diocese of York do not amount in value to the sum of Four Hundred and Fifty Pounds
