Consumer safety expert witnesses - Helping judges judge safety

Investigating whether in law a product or service was safe to be sold to or used by consumers may involve a range of technical skills and knowledge. For this work solicitors usually need to engage independent experts to give them initial advice, write a report for the court or (more rarely nowadays) to give oral evidence in the witness box. Expert witness opinions may be needed on consumer safety issues arising in cases of:

• a claim for compensation for personal injury against producer or retailer of a consumer product
• a prosecution investigation by trading standards authority of a producer or retailer of a consumer product
• a claim for compensation for personal injury against the operator or owner of a consumer service facility
• legal action by HSE over risk of accidents to consumers or the general public
