1. These terms constitute a license to Use the materials herein, which is governed by English Law and subject to the exclusive jurisdiction of the English Courts. Your Use of this website and its contents constitute your irrevocable acceptance of this these terms.
2. All commercial Use by you of this website and any of its contents is strictly prohibited. Non-commercial Use by you may be permitted provided that prior written agreement is obtained from the copyright holder. Deep linking, or similar techniques to directly reference images, pages or sound or audio-video clips is not permitted without the prior written consent of the relevant copyright holders. Such consents will be given at their sole and absolute discretion
3. By your Use of this site, you accept that FIT (“The Folk Companions, Turnberrie Castle, their members, the webmaster, the presenters, authors and copyright holders of the material herein”) do not warrant:
(1) that any of the contents are accurate, true or currently available;
(2) that there is no infringement of the intellectual property of any third parties;
(3) that your Use of this site will be error free, or that such Use will cause no harm or damage to the device upon which it is being used or that it will be possible for you to Use this website from your equipment;
(4) that this website and its contents are fit for any specific purpose or even general Use.
4. We accept NO liability, express or implied, for any damage or liability arising directly or indirectly from your Use of this site and its contents and you fully accept and agree to this.
You
(1) Accept that you retain liability for the use of this site and any of its contents and agree that you will fully indemnify and hold harmless FIT, their ISPs and any other copyright holders against any and all legal or quasi-legal procedings in any jurisdiction that may arise directly or indirectly from your Use of this site;
(2) Acknowledge that this is an amateur, not a commercially produced or maintained web-site, and that nothing herein is or represents an offer for sale, offer to provide services, an invitation to treat or any similar proposition, proposal or advertisement;
(3) Accept that we are not responsible for the contents of any external website – either referenced by this site or which references this site, whether or not we have agreed to such a reference;
(4) Accept that whilst we do not track your individual use of this site with the exceptions of optionally retaining any emails or other communications which you may send and counting the overall number of visits, FIT are not responsible for the policy of the ISP who hosts this website and cannot state what their policy will be at the time of your Use.
6. If you purchase anything through this web-site of otherwise from FIT, the following also apply:
(1) This will be a contract made under Laws of England and both parties bind themselves irrevocably to the exclusive jurisdiction of the English Courts
(2) All sales are final, goods are not sent for evaluation and (except as required by English Law) refunds are not allowable, unless goods were faulty when shipped
(3) The transaction is completed when the goods are handed by us (acting as your agents) to the Royal Mail, shipping is at the purchasers risk. You are also responsible for complying with any legislative, customs or fiscal requirements of your local jurisdiction.
(4) Whilst we have tested the CD on a range of CD players and PC equipment, we are not in a position to warrant (and we do not so warrant) that the CD will function correctly on all equipment or on the particular equipment owned by you.
(5) All performance and replication rights for material (audio, visual and written) on the disk are explicitly reserved.
7. FIT reserve the right to change or rename this site and any or all of its contents including these terms at any time, without notice, at our sole and absolute discretion. We give no guarantee of continued availability or accessibility.
8. In the event that any part of these terms are held to be invalid by an English Court, the remainder of these terms will continue in full force and effect.
