I Richard Gumbleton of Castle Richard in the county of Waterford Esq being of sound and
disposing mind and memory for which I thank God but considering the uncertainty of this
life do make this my last will and testament hereby revoking all former wills by me made
whereas by my marriage settlement dated 27 May 1743 the several lands therein mentioned
are settled in strict settlement on the issue of such marriage and a provision of £2000
made for the younger children thereof and whereas my eldest son Richard Gumbleton attained
his age of 21 years he in consideration of £200 yearly as a present maintenance and of
being paid after my decease £93 yearly or £2000 did agree to make over to me the reversion
expected which on my death he would be entitled to under said settlement in the following
lands being part of them comprised in the said settlement (that is to say) the lands of
Garrinagowle and part of Kilcoran the lands of Ballygomeashy otherwise Ballygomash otherwise
Mashtown co Cork and the lands of Shanbegg otherwise Sheanabeg alias Shyeanbegg co Waterford
in pursuance of which agreement two fines were levied of the said lands and by deed dated
6 Nov 1773 for the consideration aforesaid the said fines were declared to be the noe of
me my heirs and assigns for ever Now in order to further recompense my said eldest son for
making over such interests to me I do hereby give and bequeath to him the said sum of £2000
charged by my settlement for the younger children and to the payment of which the estate
he will on my death enjoy under such settlement would be subject was I not otherwise to
provide for the payment thereof
I give and devise unto my said eldest son and to my second son William Connor Gumbleton
and to their heirs share and share alike all my interest in the house and premises which
I purchased from William Freeman situate in Murrough's Lane in the city of Cork I give
and devise unto my said second son William Connor Gumbleton and his heirs my estate of
Dysent Coolbegg and Gurteen and all other the premises which I purchased from George
Purdon situate in the county of Cork and also my interest in the Farms of Cooligoody and
little Grace in the county of Waterford
I give and devise unto my third son Robert Warren Gumbleton and his heirs all my interest
in the farms and lands of Upper and Lower Killbegs in the county of Waterford but in case
my said son Robert Warren Gumbleton should die before he attains the age of 21 years
without issue lawfully begotten then and in such case I give and devise my said interest
in the said Upper and Lower Killbegs to my said eldest son Richard Gumbleton and his heirs
I give and devise unto my fourth son George Connor Gumbleton and his heirs my interest
in the said farm of Garrenagowle and part of Kilcoran Balklygomeashy otherwise Ballygomash
otherwise Marshtown Shyanbegg otherwise Sheanebegg otherwise Shyeanbegg situate as aforesaid
together with all my interest in that part of Kilcoran which I hold from Sir Henry Cavendish
Bart but in case my said son George Connor Gumbleton should die before he attains the age
of 21 years without issue lawfully begotten then and in such case I give and devise my
interest in said lands devised to my said son George to my eldest son Richard and my second
William and their heirs to be equally divided between them
I give and devise unto my fifth son Henry Connor Gumbleton and his heirs all my interests
in lands and houses in and near the town of Tallow in the county of Waterford with the
farm called the forge near the said town which I hold under the representation of the late
Richard Earl of Cork and Burlington but in case my said son Henry should die before he
attains the age of 21 years without issue lawfully begotten then and in such case I give
and devise my interest or interests in the lands and premises devised him to my third son
Robert Warren Gumbleton and his heirs
The following legacies I will and direct to be paid out of the different farms due to me
on various securities and out of all other my personal fortune of what kind and nature
soever that is to say
I give and bequeath unto my daughter Ann Gumbleton the sum of £1600, to my daughter
Susanna Gumbleton £1600, to my daughter Sarah Gumbleton £1600 which portions are to be
paid my said daughters as soon as the same can be called in with interest for the same
in the meantime at the rate of £5 by the hundred by the year but my will and intention
is that in case any of my said daughters shall marry without the consent of my executor
hereinafter named or of two of them first had under their hands that the fortune of her
and them so marrying without such consent unless my executor shall think proper to settle
such disobedient daughters fortune so as to make provision for her and her children
without any part thereof coming to the hands of her husband and which I do hereby give
my executors or the survivor of them a power of doing if they shall think proper
I give and bequeath to my daughter Jane, now the wife of William Daunt £22 : 1s yearly
during her life to be paid her by my executors half yearly on her sole and separate
receipt her coverture not withstanding and I give and bequeath the said William and Jane
Daunt 50 guineas to buy mourning
I give and bequeath to my son in law Henry Peard and Mary his wife the like sum of 50
guineas to buy mourning and my son in law Thomas Walton and Elizabeth his wife the like
sum of 50 guineas to buy mourning
I give and bequeath to William Spring now apprentice to Francis Haddy of Lismore in the
county of Waterford cordwainer the sum of 10 guineas to be paid him when out of his
apprenticeship
I give and bequeath to the poor of the parish of Lismore the sum of £20 and to the poor
of the parish of Tallow the like sum of £20 to be paid to and distributed amongst them
by my executors as they may think proper
And after payment of said several legacies and of all my just debts and funeral expenses
I give and bequeath unto my said 4 younger sons the said William Connor Gumbleton,
Robert Warren Gumbleton, George Connor Gumbleton and Henry Connor Gumbleton all the
rest residue and remainder of all sums of money due to me and of all other my personal
fortune of what kind and nature soever to be equally divided amongst them share and share
alike and in case any of my said four younger sons shall happen to die under age then my
will and desire is that the share of him or them so dying of same person fortune shall go
share and share alike amongst the survivors of said four sons
And I do hereby will and declare that the provision hereby made for my younger children
and which on the marriages of such of my children as are married I made for them is and
was and is hereby intended and declared by me to be in full discharge of my provision
made for younger children by my said marriage settlement and I do hereby will and direct
that before any of my married or younger children enjoy or receive any of the provisions
or legacies hereby provided for devised or bequeathed to them they and each of them shall
release and discharge any right or claim which they or any of them may have or pretend to
have to the sum or any part thereof provided for my younger children by my said settlement
which sum I intend shall not be raised but shall sink in the inheritance for the benefit
of my eldest son
Lastly I do hereby nominate constitute and appoint my said sons Richard Gumbleton and
William Connor Gumbleton and William Connor of Lismore in the county of Waterford
executors of this my last will guardians of such of my children as are minors during
their respective minorities and do will and direct that they my said executors shall
allow my three youngest sons during their respective minorities the following annuities
(that is to say) to my son Robert £40 yearly, to my son George 40 guineas yearly until
he enters the college and after £100 yearly, to my son Henry £40 yearly
