This is the last Will and Testament of me James Sutcliffe
of Bowling in the Parish of Bradford in the County of York Shopkeeper.
I will and direct that my Debts, funeral and Testamentary Expenses
be paid by my Executors hereinafter named out of my personal
Estate. And whereas my son Jonathan is indebted to me in the
Sum of Forty pounds and my son Martin is also indebted to me
in the Sum of twenty pounds.
I give devise and bequeath unto my friend Jonas Wilkinson of
Bowling aforesaid coalminer and my sons William Sutcliffe and
John Sutcliffe All my cottages or Dwellinghouses Land Ground
and all my real Estate situate in Horton in the Parish of Bradford
aforesaid or elsewhere in the said County of York, and also all
my ready money, debts owing to me, and all other my personal
Esrate and Effects, except my household furniture upon trust
that the said Jonas Wilkinson and my sons William and John or
the survivors or survivor of them or the heir's Executirs or
Administrators of such Survivor do and shall take and receive
the rents and profits of my said Real Estate, as and when they
shall become due, and for this purpose I give to them all power
and authority which I myself possess to recover the same, and
pay off and satisfy the Interest wich shall become due upon the
sum of six hundred pounds secured upon mortgage of my said real
Estate as and when the same shall become due and to invest the
remainder as to them shallseem best , and to allow the to accumulate,
till sufficient sum shall have beenreceived to enable them to
pay off and satisfy the said sum of six hundred pounds and the
Interest growing and to accrue due thereon, and when and as soon
asa sufficient sum shall have been raised Upon trust to pay off
and satisfy such sum of monies, and all Interest due thereon.
And when and as soon as the same shall have been fully paid and
satisfied I give abd devise one undivided seventh part or share
of and in all singular my said Real Estate unto my dear wife
Martha for and during the term of her natural life, and after
her decease I give and bequeath the same undivided seventh part
or share of and in he same unto and Equally amongst all my children
the said William Sutcliffe and John Sutcliffe my Daughter Hannah
the wife of David Stocks, my sons Jonathan Sutcliffe and Martin
Sutcliffe and my Daughter Rachel Sutcliffe their heirs and assigns
for ever as Tenants in Common and not as joint Tenants. All the
several six other parts or remainders of my said Real Estate
I give and devise unto and equally amongst all my said children
the said William Sutcliffe John Sutcliffe, Hannah the wife of
David Stocks, Jonathan Sutcliffe Martin Sutcliffe and Rachel
Sutcliffe their heirs and assigns for ever as Tenants in Common
and not as joint Tenants Provided and I do hereby will and direct
that the gifts and bequests by me hereinbefore made unto my said
sons Jonathan and Martin are and shall be upon this express condition
that they my said sons Jonathan and Martin do and shall respectively
pay and allow thereout unto my said wife if she shall be having,
at the time that they respectively would be entitled to their
shares of and in my said real Estate as hereinbefore by me given
and devised to them, and unto my said sons William, John, my
Daughter Hannah, my son Martin and my Daughter Rachel, each one
seventh part of the debts by them ny said sons Jonathan and Martin
respectivey owing to me as above mentioned.
Provided also that in case the said principal sum of six hundred
pounds secured upon Mortgage of my said real Estate as aforesaid
shall be called in, before a sufficient sum shall have been raised
to pay off and satisfy the same it is my will and mind and I
do hereby declare that it shall be lawful to and for my said
Trustees or the survivors or survivor of them or their heirs
Executors or Administrators of such Survivor, after paying and
applying so much money as they shall have then received or as
shall have been accumulated out of the rents and profits of my
said real Estate after repayment of the interest due upon the
said principle sum of six hundred pounds towards the payments
of the same principal sum, to borrow such sum of six hundred
pounds, or such other lesssum as may be wanted and to join in
any transfer of mortgage, or to accept a reconveyance of the
said real Estate, and to demise the same to any person or persons
willing to lend and advance such sum of six hundred pounds or
such less sum of money as may be necessary without the consent
or concurrence of my said wife or any of my said other children
their heirs Executors Administrators or Assigns.
All my household funiture I give and bequeath unto my said wife
Martha during her life and after her decease I give and bequeaththe
same unto and equally amongst all my said children their Executors
and Administrators And I do Hereby appoint the said Jonas Wilkinson
and my said sons Wiliam and John joint Executors of this my Will.
And I do revoke revoke and make void all former Wills and Codicils
by me at any time heretofore made and declare this to be my last
Will and Testament In Witness whereof I the said James Sutcliffe
the Testator have to this my last Will and Testament set my hand
and seal this fifth day of July in the year of our Lord One thousand
Eight hundred and thirty five.
