Underway: not anchored, or made fast to the shore, or aground.

Making way: moving through the water. 

By night, Motor, Sailing, CBD and Pilot vessels may only be determined as underway. 

Tugs are making way.

Fishing, Trawling, NUC, and RAM vessels may be either; they are making way if they show side and stern lights.
