NOISE AT WORK REGULATIONS 2006

These regulations are based on European Community Directives and to a large extent made explicit what was implicit in the Health and Safety at Work etc. Act 1974.

The regulations place a number of duties on employers and introduce the concept of action levels which trigger specific actions.

The action levels are as follows;

First Action Level - a daily personal noise exposure (Lep,d) of 80dB(A).

Second Action Level - a daily personal noise exposure (Lep,d) of 85dB(A).

Peak Action Level - a peak sound pressure level of 200 pascals (140 dB re 20 lPa.)

Daily noise exposure Lep,d can be regarded as the total noise exposure throughout a working day taking into account the average noise levels in an area and the length of time spent by the worker in that area.

The duties triggered by the various action levels are as follows;

Assessment of exposure - First Action Level and above.

Reduction of risk of hearing damage - All action levels.

Workers right to hearing check - All action levels

Audiometric testing

Reduction of noise exposures - Second Action Level and above.

Hearing protection - Provide to those who request and who are exposed between First and Second Action Levels.

Ear Protection Zones - Second Action Level and above.

Education and Training - First Action Level and above.

Employees have a duty to co-operate with their employer and make full and proper use of the controls provided.

To ensure that employer can prove that he has taken appropriate action records should be maintained of exposure assessments, issue of hearing protection, engineering control measures and education and training.
