Dartford Road Allotments Association: Procedures in the Event of the Death of a Plotholder

(As approved at the Fourteenth Meeting of the Committee, September 4, 1994)

The Secretary of the Dartford Road Allotments Association will prepare and maintain records of the wishes of plotholders regarding the tenancy of their plots in the event of death. Upon notification (by whatever means) of the death of a plotholder:

(a) The Secretary shall be authorised to issue a written invitation to the family of the deceased, to cultivate the plot(s) and harvest the crops until a specified date free of charge and under the normal terms of the Rental Agreement. When the notification of death has been received between April 1 and August 31, the specified date will be September 30 of the same year; when the notification of death has been received at any other time, the specified date will be one month from the date of the Secretary's letter to the family.

(b) The Secretary will also inform the family of the deceased's wishes (if known) regarding the future tenancy of the plot(s).

(c) If the deceased has expressed the wish to the Trustees that the tenancy of the plot(s) be offered to a designated person, and the Trustees do not require the plot(s) for another purpose, then the designated person will be offered the tenancy of the plot(s), that offer to expire after thirty days.

(d) If the deceased has not expressed the wish to the Trustees that the tenancy of the plot(s) be offered to a designated person, or if the designated person has turned down the offer of the tenancy, and if the Trustees do not require the plot(s) for another purpose, then the plot(s) shall be deemed vacant and available for rent, but any new tenancy will be granted only on condition that the rights of the family of the deceased specified under (a) above will be respected by the new tenant.
