Elias Froggatt (1A1), the son of Edward Froggatt (1Z4) and Catherine (née Reynolds), was baptised on January 29th, 1686/7, at Alrewas, Staffs. He married Catherine Reynolds on November 9th, 1733 at Alrewas, and they had six children. Elias died in 1756.
Elias’s Will is dated 12 March 1755 and, although he died in 1756, probate was not granted until 5 January 1763.
After legacies of one shilling to each of his three eldest daughters and £20 to Alice, he left 50% of the residue to each of his sons, Elias and Edward, when they reached the age of 18, but each with an obligation to pay £1 per annum to their mother.
In the name of God Amen I Elias Frogatt of Alrewas in the County of Stafford Yeoman, being weak of body but of sound and disposing Mind Memory and Understanding Do make this my last Will and Testament in manner following (that is to say) First I commit my Soul into the hands of Almighty God hoping through the merits of my Saviour Jesus Christ to inherit eternal life. My burial I leave to the discretion of my Executrix herein after named and for what worldly Estate it hath pleased God to bless me with, I dispose of the same as follows. First I order my debts and funeral expenses to be paid by my Executrix hereinafter named out of my personal Estate.Item I give and bequeath unto my Daughter Elizabeth Goff one Shilling. Also I give to my Daughter Catherine While one Shilling. Also I give to my Daughter Ann Frogatt one Shilling. Also I give to my Daughter Alice Frogatt the Sum of Twenty Pounds to be paid her at her age of twenty one years by my Executrix out of my personal Estate. But it is my Will that my Dear Wife Elizabeth Frogatt shall have and receive the interest of the said twenty pounds in the meantime to her own use. Item it is my Will that my said wife shall have and take the Use Interest and Produce of one Moiety or half part of all the Rest and Residue of my Personal Estate of what nature or kind soever to and for her own Benefit until my son Elias Frogatt shall attain his age of eighteen years from and after which time I give the said Moiety to my said son Elias Frogatt Subject to the proviso or Condition hereinafter mentioned. And also that my said wife shall have and take the Use Interest and Produce of the other Moiety or half of my said Personal Estate until my son Edward Frogatt shall attain his age of eighteen years from and after which time I give the said last mentioned Moiety to my said son Edward Subject also to the Proviso or Condition immediately following (to wit) Provided always and it is my Will that my said two sons Elias and Edward before they shall have or take any Benefit from the said respective (?) Legacy or Bequest to them made as aforesaid shall each of them give or procure to be given good or sufficient Security to my said Wife for the payment of two several Sums or Annuitys of Twenty Shillings each (to wit) the Sum of Twenty Shillings payable by the said Elias Frogatt and the like Sum of Twenty Shillings payable by the said Edward Frogatt to my said wife and her assigns (?) free from all deductions during the term of her natural Life if she continues a widow. The said two several Annuitys to commence from the time of the said Edward and Elias Frogatts respectively attaining their said ages of eighteen years and to be paid to my said wife by two half yearly payments in equal Shares and Proportions. Also I do hearby constitute (?) and appoint my said wife Elizabeth Frogatt sole Executrix of this my last Will and Testament hereby revoking all former Wills by me made. In witness thereof I have hereunto set my Hand and Seal this 14 day of March in the Twenty ninth year of the reign of our Sovereign Lord George the second by the grant of God of Great Britain France and Ireland King Defender of the Faith and in the year of our Lord one thousand seven hundred and fifty five.
