Bill by Robert DACKOMBE of Iford Wilts, gent, plaintiff(pf). Henry EVANS of Ewerne Dorset was seised of
lands in Bynwall Salop. About 4 years
past, ie 30Eliz, he entreated pf for help in keeping the lands. Pf spent £120 during 3 or 4 years and £100
in travel expenses as well. 2 years ago
a bargain was made to sell lands to pf for £300, and pf made a bond of £600 for
payment of £300. Henry Evans was not
able to make good conveyance and contract was void. In 33Eliz, Henry Evans forced by necessity to sell the lands,
threatened pf that unless pf bought lands for £380 he would put the £600 bond
into suit. Pf had to yield, and about
Xmas 33Eliz, pf paid £260 and bound himself with William HORTON gent in an
obligation of £240 for paying remaining £120 on 16May next. Henry Evans pretended that one William
BAILEY parson of Ashely in Salop owed him £20, and pf bound himself for £40 and
travelled to Salop to receive the £20.
But Wm Bailey did not owe £20 so pf did noy pay it to Henry Evans who
now has brought suit for bond of £40 in court of common pleas and elsewhere.

Answer by Henry Evans, gent, defendant(df).
Charges untrue. About the time
mentioned, pf accompanied the wife of df (being the sister of the pf) to df's
lands at Binwall in Astley Abbots alias Abbot Astley in tenure of Richard
Binghan or his assigns and returned to Dorset.
And after, the pf growing in dislike of his friend in Dorset with whom
he then sojourned, he resorted to the house of this df in Salop and remained
among the servants and tenants for 4 months.
And pretending to like the house he became a tenant of this df for £20
pa. And after, the pf entreated this df
to purchase the premises for £350 to advance himself by marriage in Salop. An agreement was reached, but the pf did not
keep to the agreement. And after, the
pf was a suitor to his now wife, being this df's kinswoman who was of great
wealth. An agreement was made that for
£450 to compensate df for previous losses, pf would purchase the land and this
df would travel to Salop to effect the marriage. A bond of £600 was made by pf for payment of £300. The agreement was placed in a trunk by this
df's wife, but it was embezzled, and pf neglected the bargain, causing this df
great losses (being entangled with divers payments on expectation of the sum of
money).
After the
marriage, df was content by the entreaties of his wife, and the now wife of the
pf (who desired the land) that pf should purchase the land, but he retained the
£600 bond because purchase price was £100 cheaper than agreed and because of
£200 losses and travel charge sustained by df. It was further agreed that pf
and William Horton should lend £300 to this df for redeeming grounds called
Prestmarche. He also answers the
charges concerning Wm Bailey etc etc.

This
consists of a list of 5 questions (interrogatories) to be asked of witnesses in
the suit of Robert Dackombe and his wife Silvester v Philip Cottington and his
wife Jane. All questions were variants
of whether the witness knew of £5 lent by Silvester to defendants. On the reverse are three names: Andrew
COLETHURST, William HORTON, Anthony R?YNNES all gents, dated 12FebEliz36
[1595]. [Presumably these were the
witnesses, but there were no answers in the record]

administrator of goods of Sylvester DACKOMBE wife of complainant and daughter
of Philip COTTINGTON deceased late of Leigh under Mendipp SOM; whereas the said
Philip COTTINGTON about 8Eliz was possessed of a great store of wealth of £4000
made his last will and gave £100 to Sylvester. Margery Cottington his wife and
mother of Sylvester was executor; she purchased the rectory of Shipton Montacute
for Sylvester. Defendant Edward her brother claims Sylvester was betrayed away
and married against the goodwill and liking of her brethren and friends… [will
not part up with the rectory]

brother-in-law 20 marks due for a tenement and land in Salford Somerset;
Dorothy TOOGOOD my maidservant; to Elizabeth WARD widow one mourning gown; to
Alice JEFFREYS a petticoat. In the

Memorandum
that Robert DACKOMBE late of Glasely, Co Salop & Diocese of Hereford, gent,
about 12May1621 lying sick of the sickness whereof he died, caused Peter BARRET
clerk to be sent for to write his will.
Barret demanded of Dackombe what he would give Jane his eldest daughter,
and Robert Dackombe having a purpose to make his last will and testamnent
nuncupative spake as follows: I have already given my houses and lands at
Binwall and all other lands in Abbotts Astley, Salop, to Jane and God give her
good of them. And being further asked
what he would give his daughter Mary spake as follows: I give unto my daughter
Mary the house wherein that man dwelleth meaning Henry BLAKEWAYE of Bridgenorth
the present, and the same shall remain to her for ever paying one peppercorn
unto my heir; and the said Mr Dackombe then called to his wife for the writings
and conveyance of the house and lands; and being told they were in the keeping
of one William CHEESE said let them be presently delivered unto her; and being
asked who should be his executors said that Jane my wife shall have all other
my goods and chattels and I appoint he sole executrix; there being present
sundry credible witnesses: Peter BARRET clerk, Henry BLAKEWAYE, Johan ACTON
widow, Fancis HORTON, Ann GUESE.
