Booking
Upon
agreeing on the availability of the boat you require on the appropriate dates,
you can secure the booking by completing the booking form and sending it,
together with a deposit of 25% of the charter fee, to the address shown at the
bottom of this form. This can be by credit card for convenience.
We
will then confirm the booking. The balance of the charter fee and the security
deposit become payable 28 days before the charter date.Security Deposit
In
addition to the charter fee a security deposit as detailed on the price list
payable by credit card or cheque is required to cover minor breakages, losses
and fuel and gas consumption. In the event of any insurance claim, it will cover
the boats insurance excess. Should a boat be chartered for racing, the security
deposit will normally be double the basic rate. The security deposit will be
banked, and the balance refunded within 14 day of the completion of the charter.
Hand-over and returns
Weekly
charters run from 1800 hours Friday to 1600 hours on the following Friday. For
weekend charters hand-over time is 1800 hours on Friday, with return by 1600
hours on Sunday. Other times can usually be arranged by prior agreement.
Hand-over will normally be at Southampton or at Cowes.
Upon
hand-over the yacht will be clean and ready for you with full water and fuel
tanks and gas supplies. You will be fully briefed on the boat by our staff, and
there will be comprehensive information about the equipment in the yacht's file
on board.
Charterers
are reminded that the boats should be returned on time and in a clean condition
with all fuel and water tanks full.Insurance
Our
yachts and their equipment are comprehensively insured against all usual risks
with cover in all British coastal waters and English Channel from Brest to the
Elbe. We do recommend that personal insurance is taken out for cover against
cancellation, personal accident, damage and loss of personal effects.
What to bring
In
addition to your personal clothing, you may need oilskins, bedding and
provisions, all of which can be provided by Windward Sailing if requested.
Conditions of Business
- Bookings
must be made on the form provided and accompanied by the appropriate
deposit. The Company is not bound to accept any booking and there will be no
contract until the deposit is received and cleared. Telephone reservations
will be held for five working days until the company receives the booking
form and deposit.
- The
balance of the fee is payable in full not less than 28 days before the
commencement of the charter. If such balance is not paid when due
the company may then, or at any time whilst the fee remains unpaid and
without notice to you, deem such non-payment to be notice of your
cancellation of the booking.
- Cancellation.
All payments are non-returnable except in the event of cancellation of the
charter by the Company or the preferred yacht being unavailable and there is
no suitable replacement. In either of these cases all monies will be
returned to the Client. No further liability of any sort shall be attached
to the Company. To avoid cancellation loses we strongly advise you to take
out any necessary insurance cover.
- The
company reserve the right to change the vessel used on any charter if for
any reason the vessel advertised is not available.
- A
security deposit as indicated on the price list is payable in full with the
balance of the charter fee. Where insufficient time exists for this to be
achieved cash must be paid at the time of hand-over. The balance of this
deposit will be returned within fourteen (14) days after re-delivery of the
vessel.
- All
Company craft are insured against accident and third party liability but
individual clients are not insured against personal injury, loss or
responsibility for cancellation. In your own interest you are strongly
advised against these contingencies.
- The
Client shall indemnify the Company, its servants, agents, or employees
against any liability whatsoever in respect of personal injury to the
client, damage or loss of effect for the duration of the charter, howsoever
arising. Personal insurance against these contingencies is recommended but
it is the responsibility of the Client.
- In
all cases whilst onboard the decision of the skipper shall be final. Whilst
every effort is made to give Clients the maximum possible sea time, the
Company's craft will not be put to sea if, in the opinion of the skipper,
weather or other conditions render it imprudent to do so.
- If
the return of the vessel to base at the end of the agreed charter is delayed
for any reason whatsoever, the client shall be fully liable for an excess
charge should there be any delay in the return of the vessel. The client
shall also be liable for any costs incurred by the Company in returning the
craft to base.
- The
clients must not themselves or allow any person onboard to commit any act
contrary to the laws of the Country in which the vessel is operating. If
such an act is committed the agreement between the Client and Company shall
terminate immediately without prejudice to any right of the company or the
owners of the yacht. The client alone shall bare all resulting
responsibilities and shall alone answer to the appropriate authorities for
any act which is in contravention of the laws of the Country concerned.
